Terms of Service

1. Acceptance of Terms

By accessing or using the MakeupWallah platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Platform Nature (Marketplace Model)

MakeupWallah is a technology platform and marketplace that connects users seeking beauty services ("Customers") with independent beauty professionals ("Artists").

We do not provide beauty services ourselves. Artists are independent contractors and are not employees, agents, or representatives of MakeupWallah. The contract for the provision of services is directly between the Customer and the Artist.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAKEUPWALLAH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Liability Cap

IN NO EVENT SHALL MAKEUPWALLAH'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT OF PLATFORM FEES PAID BY YOU TO MAKEUPWALLAH FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

We are not responsible for the quality, safety, or reliability of the services provided by Artists. Any disputes regarding the service quality must be resolved directly between the Customer and the Artist.

4. User Responsibilities

  • You agree to provide accurate and complete information when creating an account or booking a service.
  • You agree to treat Artists with respect and provide a safe environment for home services.
  • You agree to pay for services booked through the Platform in accordance with the agreed pricing.

5. Cancellations and Refunds

Cancellations made more than 24 hours before the scheduled appointment are eligible for a full refund. Cancellations made within 24 hours may be subject to a cancellation fee. Refunds for service quality issues are subject to investigation and are at the sole discretion of the Platform, limited to the Platform Fee as stated in Section 3.

6. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
